[Biweekly Symposium] No. 435: An Outline of Confucian Constitutionalism

Prof. Kang faces a difficult question which is that how to solve the crisis of political legality. He thought that popular sovereignty is not perfect. There are two reasons: one is that it is not a conception contains continuity of history, people who lives in the past, now and future doesn't have any connection and relationship; the other is that the state theory based on popular sovereignty can't contain the dimension of culture and history. Prof. Kang substitute popular sovereignty with national sovereignty which contains the dimension of culture and history. Then he constructs his political philosophy which takes the Confucian as subject and constitution as supplement.

Panelists appreciate his report and put forward some questions. One is the operability of the theory. Another question is how to understand and distinguish the western democracy constitution and Confucian democratic thoughts. The last one is how to integrate them with each other.

They all thought that if we want to construct political philosophy of china, we must understand both the western culture and eastern culture. Then may can we propose some solutions.
